Jason A. Bernstein has twenty-five years of experience in patent, trademark, software and copyright law and related business matters. His representative work includes preparation and prosecution of patent, trademark and copyright applications, along with a full range of legal counseling on intellectual property law and strategy.
Mr. Bernstein has crafted many creative licensing agreements and has represented numerous clients in infringement disputes and licensing negotiations from differing perspectives. He counsels clients in strategic planning designed to increase their protectable technology and brand portfolio. He also assists in the management of those portfolios and develops licensing opportunities for enhanced revenue generation. Additionally, Mr. Bernstein has been involved in strategic IP planning and due diligence investigations related to merger and acquisition transactions.
Mr. Bernstein has represented technology clients in a variety of areas including, medical devices (catheters, wound closure devices, optical coherence tomography imaging, surgical implants and operating devices), organic chemistry, polymers, pharmaceuticals, microencapsulation of biologics, monoclonal antibodies, immunoassay diagnostic methods and devices, immunology, software, business methods, mechanical apparatus, teleradiology, telemedicine, optics and optical lenses.
Additionally, Mr. Bernstein has represented a number of universities, including Harvard Medical School, Massachusetts General Hospital, Mercer University (School of Pharmacy and School of Engineering), Penn State University, University of Georgia, Emory University and University of Maryland Biotech Institute.
Before joining Powell Goldstein, Mr. Bernstein was founder and managing partner of an intellectual property law firm for twelve years. Prior to that, he worked as the director of multifocal lens technology at Ciba Vision Corporation, as patent and general counsel for Murex Corporation, a medical device and diagnostics manufacturer and as a patent attorney in the law firm environment. Additionally, he lived in Germany and performed research under a grant from the German government (DAAD) during college and studied at a university in Mexico during high school.
Mr. Bernstein is co-inventor on U.S. Patent Nos. 6,855,424; 6,834,762; and D473,113. He has been a guest lecturer at several universities including Mercer University, University of Georgia, Georgia Institute of Technology, Kennesaw State University and the Art Institute of Atlanta.
Mr. Bernstein is a 2003 and 2008 recipient of the Georgia Trend's Legal Elite Lawyers award. He is also a Martindale Hubbell AV-rated attorney.
