"We are in a period of record FCPA enforcement with more cases brought by the U.S. government in the last four years than in the prior 26 combined," said William Steinman of Powell Goldstein in Washington. His practice includes advising clients on compliance with the Foreign Corrupt Practices Act.
Steinman and other attorneys knowledgeable about the law say the globalization of America's business market and laws requiring heightened financial disclosure are the reasons for the increase.
Jefferson has maintained his innocence, saying he cannot be accused of bribery because he never delivered the money. But offering the money in return for payment is a violation of the law, Steinman said.
"Unfortunately, Representative Jefferson has added fuel to the fire," Steinman said. "It's a sad irony."
