"SunTrust attorney L. Lin Wood Jr., a partner at Powell Goldstein, said "not one thin dime" was paid by the Atlanta-based bank to dismiss the case. Wood said that Shaw, in dismissing his claims against SunTrust, "had concluded that SunTrust had not breached any fiduciary duty and was not guilty of any wrongdoing with respect to the handling of the trusts."
Wood's co-counsel in the litigation, PoGo partner Nicole J. Wade, said that in return for Shaw's dismissal of the litigation, SunTrust agreed "not to pursue the reimbursement of SunTrust's attorneys' fees and expenses from Thomas Shaw's trust."
In addition, Wade said, Shaw also is retaining SunTrust as trustee of the trust he inherited when his mother, Caroline Sauls Hitz Shaw, died. SunTrust remains trustee for separate trusts inherited by Shaw's maternal aunt, Laura Sauls Wallace, and another trust established on behalf of Emory University."
