Attorney J. Philip Carr filed a motion for a new trial on behalf of client Anthony Cain in 2008, according to the lawyer who has volunteered to take over the case if his firm determines there are no client conflicts, Daniel G. Ashburn of Powell Goldstein. "It was just like a placeholder motion for new trial," Ashburn explained. "You know, the kind you would follow up with additional things once you looked at the transcript."
