Doing business with the government requires strict compliance with a complicated web of laws and regulations. The military and other government agencies expect contractors to turn square corners.
Establishing effective compliance and training programs is the first line of defense. Properly responding to audits and government inquiries requires an experienced team that knows how to prevent contract disputes from becoming the subject of criminal or civil investigations. Our government contract lawyers work closely with the former Assistant U.S. Attorneys in the firm's white collar crime practice to promptly resolve audits and investigations so that our clients can get back to business.
Representative Matters:
- Successfully responded to an audit by the Defense Contract Audit Agency regarding an electronics manufacturer's estimating and purchasing systems
- Advised an aerospace company on the Foreign Corrupt Practices Act
- Represented a defense contractor in connection with a grand jury investigation of alleged product substitution based on faulty testing
- Defended a federal supply schedule contractor against criminal and civil False Claims Act allegations claiming they offered certain price reductions to commercial customers and not to the government
- Represented a pharmaceutical company in connection with a voluntary disclosure regarding the pricing of its drugs to certain government agencies
- Advised an aerospace company on the possible effects of a Government Accountability report on the pricing of spare parts for military aircraft
- Conducted a comprehensive analysis of state and local procurement rules in several states and advised clients on contractors' compliance with those rules
- Represented key employees of a defense electronics manufacturer in an investigation that alleged improper charging of independent research and development costs
- Developed, assisted and advised clients regarding the implementation of compliance programs under Administrative Agreements resolving suspension and debarment actions, the same including construction companies and aerospace firms
- Analyzed and implemented a nationwide discovery system for consistent practices in all localities
- Reviewed contracts federal contractors were closing for outstanding obligations of both parties, which resulted in final payments to or from the government to finalize contract close outs. Presented automated program to Defense Logistics Agency to implement in their Contract Administration function
- Performed compliance audits and updates for a major aerospace manufacturer and a major small appliance manufacturer/distributor
