Nuisance & Trespass

Environmental conditions can lead to claims by neighboring property owners that actions by neighboring property owners or conditions on neighboring property constitute a nuisance or trespass.  Many conditions can form the basis for these suits, including claims that chemical contamination is migrating from neighbors’ property, claims that stormwater runoff from a neighbor’s property has caused damage, and that construction noise and disruption constitutes and nuisance.  Our trial lawyers have handled these cases in both litigation and arbitration.

Representative Matters:

  • Handled numerous cases, for both plaintiffs and defendants in court and in arbitration, alleging that hazardous substances created a nuisance or trespass
  • Handled cases for property owners and developers in which neighboring property owners claimed damages from increased stormwater runoff resulting from development and construction activities
  • Handled litigation for property owner, developer, and contractor in which neighbors alleged that construction noise and disruption constituted a nuisance
