Prosecution of health care fraud continues as the Department of Justice's top white collar enforcement priority.

Powell Goldstein's white collar group has successfully represented a variety of health care providers in criminal, civil and administrative proceedings commenced by federal and state governments. Our attorneys represent clients in several types of proceedings: Department of Justice and Office of Inspector General of Health & Human Services investigations, grand jury investigations, qui tam and False Claim Act investigations, anti-kickback investigations and in exclusion from federal health care program proceedings brought by the OIG.

In addition, we assist clients in conducting internal investigations and in structuring and implementing health care compliance programs. Our team includes veteran federal prosecutors, as well as skilled members of our health care group.

Representative Matters:

  • Represented hospitals, durable medical equipment suppliers, home health agencies, nursing homes and other providers in grand jury investigations, as well as parallel OIG investigations and state investigations
  • Conducted internal audits and due diligence reviews for numerous health care providers, including hospitals, durable medical equipment suppliers, home health agencies, pharmacies and pharmaceutical companies
  • Represented numerous individuals in all aspects of health care fraud investigations and prosecutions
  • Advised hospitals and other health care providers on issues pertaining to ambulatory surgery centers
  • Successfully challenged CON applications of our client's competitors that would have adversely affected the existing services of our own clients
  • Assisted hospitals in obtaining extensions for their CON
  • Advised hospital clients on wide range of CON services and facilities, including perinatal, psychiatric, open-heart, home health, rehabilitation, MRI, cardiac catheterization, ambulatory surgery centers and other services
  • Advised clients on compliance with CON rules and obtained expedited review of CON issues
