The attorneys in the Higher Education Institutions and Research Parks Group at Powell Goldstein have significant experience representing universities, colleges, research parks, medical centers affiliated with higher education schools and various other organizations in the field of higher education.

The Higher Education Institutions and Research Parks Group represents a number of nonprofit policymaking organizations, structures real estate transactions for local area universities, represents university hospitals and schools of medicine, advises universities on issues relating to unrelated business income tax and compensation, advises academic medical centers on reimbursement and regulatory/compliance issues and assists some of the nation's major public teaching hospitals in negotiating affiliation agreements with medical schools.

Powell Goldstein has extensive experience in advising tax-exempt organizations, including hospitals, health systems, and universities. Our Tax Exempt Organizations Practice Group is comprised of several nationally-known attorneys who have a broad understanding of the current business and legal complexities with which tax-exempt organizations must contend.

We are experienced in reviewing financial arrangements among universities, teaching hospitals and faculty practice organizations for regulatory compliance with Medicare and Medicaid reimbursement rules, as well as federal and state referral laws.

The Higher Education Institutions and Research Parks Group has immediate access to other attorneys in the firm who practice in related fields such as real estate, public law, tax, healthcare, employment law and general litigation. With these resources, the group is able to craft practical solutions that address the institution's concerns.

The group includes a member of the Governing Board of Directors of the University HealthSystem Consortium, Chair of the HeLP Advisory Committee (a community collaboration among Children's Healthcare of Atlanta, Georgia State University College of Law and the Atlanta Legal Aid Society), and several Adjunct Professors (Emory University School of Law, George Washington University Law Center, Georgetown University Law Center, Georgia State University College of Law and Mercer University School of Law).

Recent Representative Deals/Transactions Include:

  • Represent Georgia Advanced Technology Ventures (an affiliate of the Georgia Institute of Technology) in the acquisition, development and construction of Technology Enterprise Park, a bioscience technology park under construction in Atlanta

  • Represented the Georgia State Foundation on the design and construction contracts for their Alpharetta campus and their student recreation center

  • Represented Riverside Military Academy in the school's construction contracts for a $100 million campus renovation

  • Represented the University of New Mexico, particularly the University of New Mexico hospitals, on a range of health law topics, including issues regarding Medicaid and Medicare, state health reforms and the organization and structure of the University's faculty practice plan

  • Substantial national experience in representing state university academic medical centers, including the state universities of Arkansas, Colorado, Georgia, Kansas, Kentucky, New Jersey, Ohio, Oregon, Utah, Virginia and Washington state (among others)

  • Represent a number of teaching hospitals in other states, including Florida, Massachusetts, Tennessee and Nevada, where the hospital serves as the primary teaching facility for the state university school of medicine

  • Worked closely with the Attorney General of Georgia to represent the state university system in negotiating and implementing the long-term lease of the Medical College of Georgia Hospital and Clinics to a new nonprofit corporation, negotiating and drafting all documents in the transaction
