Transit Oriented Development

Those who pioneer commercial development near public mass transit stations, whether at urban or suburban sites, encounter a multitude of challenges. Among them are acquisitions and dispositions, ground leases, agreements with neighborhood groups, design-build and construction contracts, restrictive covenants and cross-easements.

Clients need adept guidance through complex development, construction and zoning issues facing projects; they must comply with wide-ranging federal, state and local requirements while accommodating a mixture of residential, commercial, office, retail, hotel, public transportation and other uses.

The firm is special counsel to the Metropolitan Atlanta Rapid Transit Authority ("MARTA") for all transit-oriented development, which currently involves major projects throughout metropolitan Atlanta.

Together, we have structured, negotiated and documented these complex transactions for MARTA:

  • Lindbergh City Center - Mixed-use (office, retail, multi-family rental, residential condominium, hotel, rail and bus mass transit) development on MARTA-owned property, together with parking decks and other infrastructure improvements
  • Medical Center Station Development - Three-phase medical office building development under a ground lease structure, together with a multi-family rental or residential condominium project to be constructed on adjacent MARTA-owned property
  • Abernathy Road Park and Ride Lot - Office-hotel-retail project to be built on former transit park-and-ride lot under ground leases
  • Private Parking Facilities - Privately owned parking decks with retail amenities to be constructed at several transit stations by a major corporation for use by its employees and business visitors
  • Peachtree Center Station Entrance - Fee simple sale and reservation of easements and covenants in connection with expansion of historical building for a new hotel development in central business district
  • Lenox Transit Station - Development of commercial office towers in air rights above transit station
