The effective defense of chemical injury and toxic exposure claims requires a solid knowledge of physiology, chemistry, toxicology, medicine, and other scientific disciplines. Our trial lawyers use that knowledge to support admission of scientific and medical evidence and to challenge the admission of unreliable scientific and medical evidence and testimony.
Representative Matters:
- Acted as national counsel in the defense of claims of exposure to chemical emissions from building materials
- Acted as lead counsel and trial counsel for a major supplier of pest control services in pesticide exposure litigation arising in the eastern United States
- Successfully challenged the admission of medical and scientific evidence in Daubert hearings in both the Federal District and Circuit Courts of Appeal, including the first published exclusion of evidence under Daubert in the District Court in Maine
- Defended against attempts to certify class actions in both product emission and industrial accident claims
- Learned the business of our clients so that our understanding of their business and concerns were equal to our understanding of the law
- Defended a public housing authority in multiple cases alleging personal injury resulting from exposure to lead
