Competition issues arise in a variety of Executive Branch agencies, not just the U.S. Department of Justice and the Federal Trade Commission.

Effective representation in all relevant forums, whether the issue involves policy or enforcement decisions or civil or criminal proceedings, is the key to success.

Our agency practitioners have years of experience working in or with an impressive range of federal agencies concerned with domestic and international antitrust enforcement and competition policymaking. These include the Department of Justice, the Federal Trade Commission, the Federal Communications Commission, the Interstate Commerce Commission (predecessor to the Surface Transportation Board), the Department of Transportation, the Department of Energy, U.S. Attorneys Offices, the United States Trade Representative, the Council of Economic Advisors and the White House.

Together, we have successfully:

  • Represented numerous Fortune 500 Corporations in obtaining clearances for their strategic transactions from U.S. state and federal and international competition enforcement agencies, the DOT and the DOD
  • Represented a number of major corporations asking the U.S. Department of Justice, the FTC, or state attorneys general to investigate suspected anticompetitive conduct by competitors in both domestic and foreign markets
  • Represented a major developer and operator of international fiber optic telecommunications facilities in connection with the development of FCC international cable landing licensing policies
  • Defended domestic manufacturing companies subject to investigation for suspected criminal antitrust conduct, advising them on the Department of Justice Amnesty Program and conducting extensive internal audits to assess their exposure to criminal sanction
  • Defended major manufacturers in price fixing and resale piece merchandise investigations by the Antitrust Division of the Department of Justice
  • Advised a European construction company on its possible exposure to U.S. criminal antitrust sanctions for alleged bid rigging activity in a foreign market
  • Argued before the Japanese Fair Trade Commission on behalf of the American Automobile Association to open an investigation in Japan regarding exclusive dealing practices by Japanese automobile manufacturers
  • Represented a major U.S. carpeting manufacturer in a grand jury investigation probing alleged price fixing in the industry
  • Represented a major local telephone company when the FCC reviewed the company's merger with another major phone company
  • Represented railroad clients before the Surface Transportation Board
  • Advised a foreign-based provider of telephone directory assistance services seeking access to the U.S. market before the FCC
  • Represented a major foreign-based airline seeking Department of Transportation approval and antitrust immunity for a code share relationship with a U.S.-based airline
