Patents

Patents are property rights limited in scope, geography and duration. A patent gives the patent owner the right to keep others from making, using, selling, offering to sell and importing the patented invention as et forth in the claims.

The law relating to patents is defined by a constantly shifting collection of statutes and judicial interpretations. In fact, most IP lawyers agree that the last two years have seen more changes to the patent practice than the preceding two decades, making it essential to obtain quality representation for protecting the intellectual property rights of a business. Recent development in the law have opened the doors in the protection of business methods, established a process of claim construction analysis, and interpreted the research exemption for the pharmaceutical industry. Significant legislative changes have also been made to the patent code that introduced a host of changes to the process of patent and trademark procurement, all of which must be strategically followed to obtain the best possible IP protection. Through a thorough working knowledge of IP law, coupled with a depth and diversity of experiences, Powell Goldstein lawyers provide a skill and responsiveness that is necessary in the practice to best serve the needs of our clients.

Our attorneys work with small and large companies to develop and implement strategies for maximizing protection of intellectual property. We help map out patent filing programs, perform searches and evaluations and prepare and prosecute patent applications. We also provide infringement and invalidity evaluations. We frequently work alongside our clients' development and engineering teams to provide feedback on patentability or ingringement issues to help reduce product development time and increse the possible protection and value of the inventions.
