Domain Names

The right to use a certain domain name can be central to protecting a company's trademark. Our attorneys have litigated the right to use domain names in the courts and under the ICANN domain name dispute procedures (UDRP). Even before the World Intellectual Property Organization (WIPO) was named as dispute arbitrator under ICANN, we had extensive experience with WIPO arbitration procedures. As a result, we help clients thoroughly weigh the pros and cons of going to court or using the ICANN UDRP.

When clients choose the ICANN UDRP, we help them select the best forum for arbitrating domain name disputes from the "approved provider" options: WIPO, the CPR Institute for Dispute Resolution, eResolution/Disputes.org and The National Arbitration Forum. We also advise clients on the potential uses of the Anti-Cybersquatting Act and other legislation to protect their rights on the Internet.
